Introduction
Following the EU General Data Protection Regulation (GDPR) and its implementation on 25th May 2018 maintaining the security of your data is a priority of Unsworth Rose and we are committed to respect your privacy. We will handle your data fairly and legally at all times. We are also dedicated to being transparent about what personal data and sensitive personal data we collect from you and how we may use such data.

For the purposes of the Data Protection Act 1998 (“the Act”), the data controller is Unsworth Rose (Solicitors) LLP of 19 Princess Road, London NW1 8JR. Our nominated Data Protection Office for the purpose of the Act is currently Ibby Aziz. This notice may need to be updated from time to time. Please check back frequently to see any updates or changes to our privacy policy. We will inform you if there are any significant changes.

Information about you
We are obliged to obtain and hold documents which will contain your personal data in relation to which the GDPR 2018 will apply, by the Proceeds of Crime Act 2002 and the Money Laundering Regulations 2017 (MLR 2017) which came into force on 26 June 2017.

In relation to property transactions, we will collect and process personal data about you, including mortgages, due to the requirements of that lender and otherwise as necessary to carry out your instructions to us generally. The data will include taking copies and electronically storing photographic ID (such as passport or drivers licence, bank statements and utility bills) as provided by you to us. We will not be able to act on your instructions if you do not supply us with the personal data that we have requested as we will be in breach of our statutory requirements. We do not, therefore, require your consent to process your data in the above circumstances as we have a legitimate interest under GDPR. We will seek your specific consent if in the unlikely event that we are required to process your data outside the remit of the above. You have the right to withdraw your consent in such an event.

Information you give to us
This is information about you that you give us any time throughout your matter including, without limitation, any information given in forms or documents, at a meeting, or by corresponding with us by phone, email or otherwise. This information is likely to include your name, address, email address and phone number, information about your employment, financial and credit information, passport, driving licence, bank statements, utility bills, personal description, personal circumstances and photograph. You consent that we may contact you by phone (including mobile) email and post.

Information we collect about you and information supplied to us by other sources
This is information we may receive about you by virtue of our instructions in your matter and our representation of you. This will include, without limitation, information provided by any third party such as other solicitors, lenders, brokers, agents, experts, other advisers and any information of public record; professional indemnity insurers and brokers, auditors, the Solicitors Regulation Authority and the Law Society other professional advisers; Courts, Land Registry, Companies House, HMRC and other such public bodies.

Using your Information
We will use the information required for the purpose for which we are instructed; to carry out our obligations arising from any contracts entered into between you and us and to provide you with the advice and services that you request from us; to provide you with information about other services we offer which may be of interest and to notify you about changes to our service.

Disclosing your Information
We will only disclose or share your personal data if we are under a duty to do so in order to comply with any legal obligation or where required by statute or otherwise in relation to your matter. This includes exchanging information with other companies and organisations for the purposes of fraud and money laundering protection and instructing or liaising with other professionals such as barristers, surveyors, accountants or the Land Registry.

We will not share your data for marketing purposes or profit but only as required in order to best deal with your work.

Storage of your Information
We will take all reasonable steps necessary to ensure that your data is treated securely and in accordance with this privacy policy. We will take appropriate technical and organisational measures to keep your information confidential and secure in accordance with our internal procedures covering the storage, access and disclosure of information. Your information will be kept electronically and in paper files in accordance with our regulatory requirements. The Law Society requires us to store papers, depending on the matter, for up to 12 years. We will do our best to protect your personal data but we cannot guarantee the security of it as, unfortunately, the internet is not completely secure. We will use strict procedures and security features to try to prevent unauthorised access.

Access to your Information
